Terms of business

 

“Our”, “We” & “Us” shall mean Joel Bugg Furniture & Spaces Ltd.

 General

These terms of business apply to services and goods supplied by Joel Bugg Furniture & Spaces Ltd., 43 Hantone Hill, Bathampton, Bath BA2 6XD.

Quotations

Any quotation given to you by us, is an invitation to you to place an order with us only. Unless otherwise stated, all prices we quote are exclusive of VAT. Quotations are valid for a period of 30 days from the date of issue.

For the avoidance of doubt, project installation quotations do not include the final connections of electrical appliances and water supplies to appliances.

Confirmation of order

Confirmation of an order will only be sent when all details have been agreed with us and the first instalment payment has been made. Once we send this confirmation and payment has cleared, there is a binding and legal contract between you and us. No addition or alteration to the order will be valid unless agreed in writing by us. In the event of such alteration, additional charges may be made.

Payment

Our invoice payment terms are 7 days from date of issue.

All initial design fees, as quoted in our Project Proposal document are payable in full on commission. This is also applicable to design only projects.

For manufacture and installation projects, a first payment of 50% of the total purchase price is due on acceptance. Prior to installation, a further 45% is due. The remaining balance of 5% is due 7 days after installation.

If there is a need for you to delay the agreed installation date, the 45% payment will still be due, unless otherwise agreed in writing with us.

We reserve the right to cancel the project order if stage payments are not met within the terms requested.

All goods remain the property of Joel Bugg Furniture & Spaces Ltd. until the goods are paid for in full.

Delivery

We aim to meet delivery dates that we have set and agreed with you, however, we will not be held liable for any force majeure that may affect our ability to deliver on time.

Responsibility of your goods will pass to you upon delivery. Any damage or loss caused by persons not employed by us, such as builders or other tradesperson is the responsibility of you. The risk in the goods not installed by us shall pass to you on delivery. For goods installed by us, risk shall pass after installation.

Installation

We will carry out a site inspection before installation. If the site is deemed unsuitable, we maintain the right to delay installation until such time factors discussed are remedied.

We will assume that your property is not subject to any listing and that the installation works will not contravene any planning conditions or obligations unless you tell us otherwise.

If you wish to postpone the agreed installation date and there is a need for us to store the completed furniture/appliances, then we reserve the right to charge for storage on a daily basis from a period of one month following the agreed installation date.

Worktops

In the instance of stone or Corian worktops, these are templated once your furniture is fitted. The fitters will return 2 to 3 weeks later to fit the worktop.

Cancellation

As our furniture is bespoke and made to measure, we can only accept cancellations of orders in writing and on the condition that we are reimbursed all costs, expenses or losses resulting from the cancellation.

Guarantees / Warranty

Appliances are guaranteed by the individual manufacturer’s standard warranty. We will register all appliances purchased through us on your behalf. We will manage any claims that may arise during the period of the standard warranty for you, however, we are not liable for any manufacturing faults or technical issues appliances may have and this must be pursued between you and the manufacturer. Final connections of electrics and water to appliances is the responsibility of the client.

Our furniture is covered by a five-year warranty against a manufacturing fault. Where we have cause for concern that misuse may have caused a claim, then repair charges or necessary parts may be charged.
